Justice official to plead the Fifth before Senate panel

WASHINGTON (CNN) -- A Justice Department official will refuse to answer questions during a Senate committee hearing on the firing of eight U.S. attorneys, citing her Fifth Amendment right not to incriminate herself, her lawyer said Monday.
In a letter sent to the Senate Judiciary Committee, Monica Goodling's lawyer said she would not testify because senators have already decided that wrongdoing occurred.
"The public record is clear that certain members of the Senate Judiciary Committee have already reached conclusions about the matter under investigation and the veracity of the testimony provided by the Justice Department to date," John Dowd, Goodling's lawyer, said in a letter to the committee's chairman, Sen. Patrick Leahy, D-Vermont.
The letter said Goodling learned that a senior Justice Department official blamed her and other Justice Department officials for any misleading statements he had made to one of the Democratic senators who has pushed for answers about the firings, Sen. Chuck Schumer of New York.
Goodling is a senior counsel and White House liaison to Gonzales. She is taking a leave of absence from the department.(Watch why Goodling took the Fifth )
The committee has subpoenaed Goodling to testify Thursday. Democratic and Republican senators have raised questions about the firings, which e-mail released by the Justice Department suggests may have been done for political reasons.
Democrats said they continue to want Goodling to testify.
"It is disappointing that Ms. Goodling has decided to withhold her important testimony from the committee as it pursues its investigation into this matter, but everybody has the constitutional right not to incriminate themselves with regard to criminal conduct," Leahy said in a written statement. "The American people are left to wonder what conduct is at the base of Ms. Goodling's concern that she may incriminate herself in connection with criminal charges if she appears before the committee under oath."
Goodling's decision to plead the Fifth Amendment "raises even more questions concerning the potential misconduct and legal violations by the administration in this ongoing scandal," said Rep. John Conyers, the Michigan Democrat who leads the House Judiciary Committee. That committee also wanted to hear Goodling's testimony on the firing.
The White House said Goodling's decision shows how political the investigation has become.
"It is unfortunate that a public servant no longer feels comfortable that they will be treated fairly in testimony in front of Congress," White House spokeswoman Dana Perino said.
"The attorney general, with the president's support, has urged members of the Justice Department to cooperate with Congress' request for testimony," Perino said. "However, we must respect the constitutional rights of the people involved and the decision of those individuals and their counsel to protect those rights."

The third place:sociology of the coffee house

There is no doubt that coffee holds a special place in the hearts of many Americans. The second most widely consumed beverage after water provides comfort, taste, and solace to those who drink it. A certain mystique surrounds the beverage, and new innovations in its preparation bring the coffee industry new customers every day. But the consumption of coffee goes well beyond the latest innovation or the most recent crop. In fact, there is a direct correlation between those who drink coffee at the local café today and the women who met and socialized at the well where they collected water hundreds of years ago.
The Social Science of the BeanThere are many reasons coffee has become deeply ingrained in our society. Of course, the beverage tastes wonderful, but the popularity of specialty coffee runs much deeper than that. It is very easy for most Americans to buy great beans, purchase wonderful brewing devices (machines, grinders, brewers) and prepare coffee each morning at home in a matter of minutes. Why then do coffee drinkers go to a coffeehouse and pay two to three dollars for something they can prepare at home for a fraction of the cost? The answer isn't found in chemistry or physics books that explain proper brewing principles; it's found in the textbooks of sociology and psychology.
The Third Place TheoryAt the National Coffee Association (NCA) conference in Florida March 7-9, I attended the keynote address by Howard Shultz, the chairman of the board of Starbucks. Shultz is famous in the history of specialty coffee for taking a few simple coffee stores in Seattle and expanding his vision into a worldwide phenomena that now includes over 5000 cafés. After hearing his speech, it became clear to me how his insight and passion had created the world's largest coffee chain. It has long been known that Shultz sculpted his vision around "place". Of course, marketing and product had to meet certain standards, but it was the creation of the "third place" that drove his vision and fueled the explosion of retail coffee outlets around the globe.
In his book, The Great Good Place: cafés, bookstores, bars, coffeeshops, hair salons and other hangouts at the heart of community, Ray Oldenburg investigates and explains this third place that Shultz found essential to the success of Starbucks. The third place, says Oldenburg, is where people congregate to find a sense of community outside of the home and workplace. By their nature, humans have a desperate need for somewhere to meet friends or take solace in the familiarity of both people and their surroundings.
From the beginning of our young country, bars serving alcohol have been the primary third place. From the saloons we see in early TV Westerns to modern day hip and cool watering holes, bars were once the only option for people to meet and socialize. The problem with bars for many people is alcohol. Not everyone wants to achieve an altered state, and the stigma surrounding this third-place option has grown with the enactment of stricter drunk driving laws and concerns about potential health risks.
It's not about the Coffee—but the BreakIn the early years of this industry, Roger Sandon, founder and publisher of Café Olé Magazine, said to me, "Bruce, this is not about the coffee… it's about the break." Another Seattle friend, Italian-born Mauro Cipolla, founder of Caffe D' arte, echoed the same sentiment. Mauro asserts that while the coffee in Italy is excellent, the reason there are over 200 thousand coffee bars in that country is that they provide a place to meet friends and neighbors. These small bars on nearly every corner are where you learn your close friend's wife is pregnant, someone’s uncle is ill, or the score of last night's soccer match.
North America is finally catching up to Europe, with its older and well-established third-place culture. In the past ten years, coffee establishments have played the major role in satisfying the inner need of Americans for a third sanctuary.
A good friend of mine, who recently moved to a bedroom community of Seattle, told me more about how thrilled she was with the local coffee bar on the corner than she was with the beautiful apartment she lived in with a view of Lake Washington. Each time I called her, she talked more about the hangout she had found than any other part of her life. She told me about about a group of people who met each morning before work. She was thrilled the day they asked her to join them, and she told me she now spends hours socializing with the group almost every Saturday and Sunday morning. This particular woman was involved in the coffee industry and could brew up a great cup at home, but within the confines of her kitchen she could not brew up the friendship or fulfill the need we all have as humans to share and interact with others.
From the Bonfire to the Modern Day Coffee BarAs we enter this new century, I believe we are only seeing the beginning of the influence that specialty coffee will have on society. Many have predicted the industry will soon reach its saturation point; I believe this is far from true. Attendance at coffee tradeshows is breaking records. Companies within the industry are experiencing unprecedented growth. Coffee establishments featuring the third place are opening by the hundreds each day. The great cup of coffee—the aroma, the taste—is only part of the reason. It is the human need for contact that drives this industry. Anthropologists who study our culture in the future will discover that coffee bars met the needs of 21st century people in the very same way bonfires—bonding fires—served the cave dwellers who gathered at night many, many years ago.

YouTube May Have Met Its Match

The News Corp.-NBC online video service could be a worthy rival to Google's popular site—for viewers and content partners alike

With friends like News Corp., who needs YouTube? Not NBC Universal, apparently. Ditto for AOL, Microsoft, and a who's who of other Internet giants throwing their weight behind a News Corp.-NBC video-sharing service that could prove to be a potent alternative to Google's YouTube.
Here's why. The deal lets Yahoo! (YHOO), Microsoft (MSFT), and Time Warner's (TWX) AOL—Google's biggest rivals in search—all broadcast clips and full episodes of popular TV shows from two of the most widely watched networks on TV: NBC and News Corp.'s Fox. The parties will divvy up advertising revenue while their customers get online access to such shows as 24, The Simpsons, The Tonight Show, and My Name Is Earl.
News Corp. (NWS) Chief Operating Officer Peter Chernin described the deal as a "game changer" for Internet video and hinted more partnerships will follow. The new service will include technology that helps partners keep close tabs on who's watching what, and where—making it easy to track both audience and ad dollars. "We're excited about the potential for this alliance and we're looking forward to working with any content provider or distributor who wants to take advantage of this extraordinary opportunity," Chernin said.
No. 1 Video Site Weakened?
That "any" could include such media companies as Viacom (VIA) and Disney (DIS) and other video services such as Joost—just about any company in the business of creating or distributing video entertainment. "They are all pretty concerned about YouTube," says Forrester (FORR) analyst Josh Bernoff.
Like News Corp. and NBC, Google (GOOG) is keen to set up partnerships that will let it distribute content via YouTube. Trouble is, as the biggest online video service, YouTube has a strong hand in negotiations. Big media would love to get its programming in front of YouTube's large audience, but it's also concerned Google will get too large a share of ad revenue and too much control over content.
Viacom, owner of Comedy Central and MTV, has complained that Google won't offer fair compensation for content, through licensing deals or revenue sharing, and doesn't prevent users from uploading unlicensed, copyrighted content to YouTube. This month, Viacom went so far as to sue Google after discussions broke down over copyright controls and licensing of the network's popular shows and clips (see BusinessWeek.com, 3/14/07, "Viacom's Suit Won't Snuff Out YouTube"). Google's YouTube has limited partnerships with more than two dozen content creators, including General Electric's (GE) NBC, CBS (CBS), and the BBC, but it has been unable to close long-term, wide-reaching distribution deals with major networks.
Potential Earnings Hit
Now that entertainment companies have an alternative distribution network, those negotiations won't get any easier. After the announcement, Viacom indicated it would be willing to work with the NBC-News Corp. partnership, saying in a statement: "A new online video distribution platform that respects copyrights is a welcome addition to the industry."
What's more, the specter of Viacom and other networks providing their content to Google's main rivals, while excluding Google and YouTube, has to be worrisome for the search giant. Though unlikely to squash YouTube—which showed 54.7 million videos in January alone, easily making it the most popular video site, according to comScore Video Metrix—it does have the potential to severely limit YouTube's potential earning power.
A big revenue driver for YouTube in the future will be video ads. Research firm eMarketer estimates that nearly $3 billion will go to online video advertising by 2010, up from $775 million this year. Of that amount, roughly 75% will go to advertising on content created by media companies such as the major networks.

Evolution is unacceptable ?

The Second Law of Thermodynamics, which is accepted as one of the basic laws of physics, holds that under normal conditions all systems left on their own tend to become disordered, dispersed, and corrupted in direct relation to the amount of time that passes. Everything, whether living or not, wears out, deteriorates, decays, disintegrates, and is destroyed. This is the absolute end that all beings will face one way or another, and according to the law, the process cannot be avoided.

This is something that all of us have observed. For example if you take a car to a desert and leave it there, you would hardly expect to find it in a better condition when you came back years later. On the contrary, you would see that its tires had gone flat, its windows had been broken, its chassis had rusted, and its engine had stopped working. The same inevitable process holds true for living things.

The second law of thermodynamics is the means by which this natural process is defined, with physical equations and calculations.

This famous law of physics is also known as the "law of entropy." In physics, entropy is the measure of the disorder of a system. A system's entropy increases as it moves from an ordered, organized, and planned state towards a more disordered, dispersed, and unplanned one. The more disorder there is in a system, the higher its entropy is. The law of entropy holds that the entire universe is unavoidably proceeding towards a more disordered, unplanned, and disorganized state.

The truth of the second law of thermodynamics, or the law of entropy, has been experimentally and theoretically established. All foremost scientists agree that the law of entropy will remain the principle paradigm for the foreseeable future. Albert Einstein, the greatest scientist of our age, described it as the "premier law of all of science." Sir Arthur Eddington also referred to it as the "supreme metaphysical law of the entire universe."

Evolutionary theory ignores this fundamental law of physics. The mechanism offered by evolution totally contradicts the second law. The theory of evolution says that disordered, dispersed, and lifeless atoms and molecules spontaneously came together over time, in a particular order, to form extremely complex molecules such as proteins, DNA, and RNA, whereupon millions of different living species with even more complex structures gradually emerged. According to the theory of evolution, this supposed process-which yields a more planned, more ordered, more complex and more organized structure at each stage-was formed all by itself under natural conditions. The law of entropy makes it clear that this so-called natural process utterly contradicts the laws of physics.

Evolutionist scientists are also aware of this fact. J. H. Rush states:

In the complex course of its evolution, life exhibits a remarkable contrast to the tendency expressed in the Second Law of Thermodynamics. Where the Second Law expresses an irreversible progression toward increased entropy and disorder, life evolves continually higher levels of order.

The evolutionist author Roger Lewin expresses the thermodynamic impasse of evolution in an article in Science:

One problem biologists have faced is the apparent contradiction by evolution of the second law of thermodynamics. Systems should decay through time, giving less, not more, order.

Google's wonderland, Trouble in Paradise

Article:
The fairy tale existance of Google is starting to experience
shockwaves.

So, what's the source of these shockwaves? Click fraud. As my
readers know, I've written several articles on the subject of
click fraud, suggesting that since it's the market leader,
Google should take a more proactive approach with the problem of
click fraud.

Until now, Google has been mostly quiet about the subject,
issuing this single statement to the Securities and Exchange
Commission:

"We are exposed to the risk of fraudulent clicks on our ads. We
have regularly paid refunds related to fraudulent clicks and
expect to do so in the future. If we are unable to stop this
fraudulent activity, these refunds may increase. If we find new
evidence of past fraudulent clicks, we may have to issue refunds
retroactively of amounts previously paid to our Google Network
members."

So, why isn't Google doing more about click fraud? In one of my
articles, I theorized that with the amount of money involved,
it's actually more cost effective for Google to issue an
occasional refund to its advertisers, than to develop technology
to eliminate click fraud.

That theory was echoed in a recent article, in which the author
wrote:

"Google's primary defense against click fraud has been to refund
advertisers their money if they complain and Google sees
evidence that fraudulent clicks have occured. The problem with
this is that the burden of proof is on the advertiser ... and
Google knows that most advertisers will not take the time to
argue. Therefore, Google has a financial incentive not to deal
with click fraud on their own. It not only costs them to deal
with the problem but if they do find a solution to stopping
click fraud ... it will cost Google much more when they don't
get paid for 20 percent or more of their clicks."

However, all of that may be about to change. At an investor
conference last Wednesday, Google CFO George Reyes stated:

"I think something has to be done about this really, really
quickly, because I think, potentially, it threatens our business
model."

My question is this: What took Google so long to come to that
realization? It's not like click fraud just magically appeared
yesterday. The media has been reporting on the problem for at
least the last 3 years.

Smug in its ivory tower, did Google think the problem was just
going to go away by itself? Or was it waiting for Overture or
one of the smaller pay-per-click companies to solve the problem,
so it wouldn't have to deal with it?

These are troubling questions, to say the least. Even more
troubling is Google's passive approach to a serious problem,
which in my opinion has been reprehensible.

It should be interesting to see what Google's next move is.
Google CFO George Reyes statement notwithstanding, I'll believe
Google is serious about eliminating click fraud, when I finally
see it!

Home Equity Loans Rates Guide

Do you need to pay your college tuition fee? Does your home need massive repairing? Did the addition of a new baby in the family lead you to think of getting a bigger family car? Taking out a home equity loan may be the quickest and most practical solution to your sudden financial needs. However, you need to know that while taking out a loan with your home as collateral is not as simple as it looks.

A home equity loan does not come for free. You will have to pass certain documents, get through credit rating standards, and pay a variety of fees to get started.

What fees are these?

A home equity loan's costs consist of interest rates and transaction expenses, also called closing costs, or the rates linked with the successful closing of a home equity loan deal. These include lawyers fees, application fees, credit reports, title search fees, notary fees, insurance fees, property appraisal fees, loan document preparation fees, and other closing expenses.

Normally, closing expenses average at between 2% and 5% of the amount you loaned, so you should expect not to get everything you borrowed initially. Be careful of mortgage lenders that advertise no closing cost deals, because there is definitely no truth to this.

Whenever you take out a home equity loan, there is a price you will need to pay for the convenience of getting money at once. If the company says it offers no closing costs deals, it is likely that it has already factored the fees into the interest rate. If you're thinking of borrowing a huge amount, don't go into these kinds of deals. However, it should be relatively harmless if you're only planning to take out a small value.

In addition to the abovementioned fees, you will also have to pay so-called points on closing. Points are service fees you pay at only one time when the deal is sealed. They are related to interest rates, so the more points you pay, the lower your interest rates will become, which is not really a bad thing, when you think about it.

To be able to understand and appreciate the presence of points, mention it in dollar terms. For example, instead of saying you are paying three points on your $20,000 home equity loan, you can say you are paying $600 in points. This way, you will have a better grasp of the amount you're shelling out, and you can more effectively keep track of your cash outlay. Simply referring to your costs in terms of small value 'points' can cause you to lose track.

In sum, taking out a home equity loan is not really expensive, but you have to realize that it does not come for free. Whether you choose to take out a standard home equity loan or a home equity line of credit (the two types of home equity loans), you should expect to face significant costs.

3 Most Expensive Home Equity Loans Mistakes

Home equity loans can be a wonderful source of credit. However, when it comes to home equity loans, you can’t afford to make a mistake—your house is the collateral. Below are the three the most common, and the most expensive, home equity loan mistakes.

Mistake One: Choosing the Wrong Home Equity Lender

The competition between home equity lenders is fierce. They are currently offering the lowest interest rates that have been seen in years. Before choosing a home equity lender, there are a few things that you should consider, such as interest rates, closing costs, lending fees, and loan terms and conditions. Don’t be afraid to shop around. Choosing the wrong lender could be one of the biggest home equity loan mistakes that you can make.

Mistake Two: Borrowing Too Much

Borrowing too much money is a common home equity loan mistake. No matter how much money you borrow, you will have to pay it back. Consider this carefully before deciding on the size of your home equity loan. Remember, if you get a large loan and cannot make the large payments, you could be putting your home at risk.

Mistake Three: Missing Payments

Taking out a home equity loan is serious business, and should be treated as such. If you take out a home equity loan, the worst mistake that you can make is missing payments. Once you get behind, it can be very hard to catch up. If you miss too many payments, the bank can seize your house. Before taking out a home equity loan, make sure that you carefully review the terms and conditions. Ask your lender what will happen if you fall behind or miss a payment. You may also want to ask about grace periods, skipping a payment, loan insurance, and refinancing

Alternatives: Home Equity Loans

There are other ways to borrow money from a lending institution. For example, you may want to explore second mortgage loans. However, these plans also place an additional mortgage on your home; second mortgage money usually is loaned in a lump sum, rather than in a series of advances made available by writing checks on an account. Also, second mortgages usually have fixed interest rates and fixed payment amounts.

Other options include borrowing from credit lines that do not use your home as collateral. These are available with your credit cards or utilizing unsecured credit lines that let you write checks as needed. In addition, you may want to ask about loans for specific items, such as cars, boats, or tuition.

Before rushing in, you should consider all your options and see whether you would benefit from a home equity credit line or you would do better with other financial product. And if you decide to request a home equity credit line, request different quotes and compare what each lender has to offer. You’ll soon learn that by bargaining a little you can get great deals on home equity credit lines
